<p style="text-align: justify;">In a batch of connected appeals arising from the controversial <strong>2016 WBSSC recruitment process</strong> for <strong>Groups C, D and Assistant Teachers (Classes IX–X and XI–XII)</strong>, the Hon’ble Supreme Court of India upheld the <strong>Calcutta High Court&#8217;s judgment dated 22.04.2024</strong>, which had declared the <strong>entire selection process null and void</strong>.</p>
<p style="text-align: justify;">The petitioners before the Supreme Court included numerous appointees—some found tainted, some claiming innocence, many with over 5 years of service—as well as the <strong>State of West Bengal</strong> and <strong>West Bengal School Service Commission (WBSSC)</strong>. They contended that only illegal appointments should have been cancelled, not the entire recruitment.</p>
<p style="text-align: justify;">However, after a detailed factual and legal analysis, the Hon’ble Court ruled that the <strong>recruitment process was irreparably tainted by systemic fraud, procedural lapses, and intentional cover-ups</strong>. The judgment establishes the following:</p>
<h2 style="text-align: justify;"><img src="https://s.w.org/images/core/emoji/17.0.2/72x72/1f4dd.png" alt="📝" class="wp-smiley" style="height: 1em; max-height: 1em;" /> <strong>Factual Findings:</strong></h2>
<ul style="text-align: justify;">
<li>Recruitment was governed under the WBSSC Rules, 2009 &amp; 2016; ~24,640 posts were notified in 2016.</li>
<li>Evaluation of OMR sheets was outsourced to <strong>M/s. Nysa Communications Pvt. Ltd.</strong>, with no transparency in marks or panel formation.</li>
<li>WBSSC <strong>destroyed OMR sheets</strong>, justifying it under Rule 21 (only for teachers), despite pending recruitment litigation.</li>
<li>CBI investigation (based on HC orders) revealed large-scale <strong>manipulation of marks, unauthorized appointments</strong>, and <strong>tampering of selection data</strong>.</li>
<li>The <strong>Justice R.K. Bag Committee</strong> reported serious irregularities in Group C &amp; D appointments, including <strong>rank jumping</strong>, <strong>fake panels</strong>, and <strong>prima facie criminal liability</strong> of WBSSC officials.</li>
<li><strong>Hard disks recovered from ex-Nysa employee Pankaj Bansal</strong> and scanned data from <strong>Data Scantech</strong> proved discrepancies. Thousands of OMR-based scores were inflated.</li>
</ul>
<h2 style="text-align: justify;"><img src="https://s.w.org/images/core/emoji/17.0.2/72x72/2696.png" alt="⚖" class="wp-smiley" style="height: 1em; max-height: 1em;" /> <strong>Legal Principles Applied:</strong></h2>
<ul style="text-align: justify;">
<li>Relying on <em>Sachin Kumar v. DSSSB</em>, <em>Inderpreet Singh Kahlon</em>, and other precedents, the Court reiterated that <strong>entire recruitment must be quashed</strong> if:
<ul>
<li>The fraud is <strong>widespread</strong> and affects the <strong>integrity of the process</strong>,</li>
<li><strong>Segregation of innocent from guilty is impossible</strong>,</li>
<li><strong>Public confidence in the selection is undermined</strong>.</li>
</ul>
</li>
</ul>
<h2 style="text-align: justify;"><img src="https://s.w.org/images/core/emoji/17.0.2/72x72/1f9d1-200d-2696-fe0f.png" alt="🧑‍⚖️" class="wp-smiley" style="height: 1em; max-height: 1em;" /> <strong>Court&#8217;s Conclusions &amp; Directions:</strong></h2>
<ul style="text-align: justify;">
<li><strong>Cancellation of entire 2016 recruitment</strong> process upheld.</li>
<li><strong>Tainted candidates</strong> must <strong>refund salaries</strong> with <strong>12% interest</strong>.</li>
<li><strong>Non-tainted candidates</strong> are relieved from refund but <strong>lose their employment</strong>.</li>
<li><strong>Disabled candidate Soma Das</strong> allowed to continue on <strong>humanitarian grounds</strong>, but other such candidates can continue <strong>only until fresh recruitment</strong>.</li>
<li><strong>Previously employed non-tainted candidates</strong> may rejoin their <strong>old government positions</strong>, with <strong>seniority preserved</strong> (no salary for the disputed period).</li>
<li>A <strong>fresh WBSSC recruitment</strong> is to be conducted <strong>after elections</strong> through a transparent, open tender process.</li>
<li>The Court <strong>rejected delay, estoppel, and natural justice arguments</strong>, citing that <strong>fraud vitiates everything</strong>.</li>
<li>A separate <strong>CBI probe into creation of supernumerary posts</strong> by the State is to continue, listed for further hearing on <strong>08.04.2025</strong>.</li>
</ul>
<p style="text-align: justify;">The Court made it clear that <strong>systemic corruption and administrative complicity</strong> cannot be allowed to override the <strong>constitutional guarantees under Articles 14 and 16</strong>. Even where individual innocence exists, if the selection process is <strong>irretrievably compromised</strong>, <strong>no appointment can survive</strong>.</p>
